Terms of Service

1. The service

REKommend (“the service”) is a hosted review-management platform operated by REK Marketing & Design (“REK,” “we”). By signing up or using the service you (“client,” “you”) agree to these Terms.

2. Your account

You are responsible for keeping your login credentials and API key secure and for everything that happens under your account. Notify us immediately at support@rekmarketing.com if you suspect unauthorized use.

3. Messaging consent — your responsibility

REKommend sends SMS and email on your behalfto your customers. You — not REK — are the “sender” under the TCPA, CAN-SPAM, and carrier rules (A2P 10DLC, toll-free verification). You represent and warrant that:

  • You have explicit prior consent from every contact you upload or send through the API. Consent must be clear, recorded, and obtained for the specific purpose of receiving review-request messages from your business.
  • You can produce proof of consent (signed forms, recorded calls, opt-in checkboxes on intake, etc.) within 5 business days if a carrier, regulator, or REK asks for it.
  • You will not upload contacts purchased from third parties, scraped from public sources, or otherwise obtained without the contact's knowledge.
  • You will honor opt-outs. STOP is handled automatically, but if an end customer contacts you directly to opt out, you must remove them from any external systems too.
  • The business name and templates you configure accurately identify you as the sender.

If you breach this section we may suspend your account immediately without refund and report the violation to the affected carrier. You indemnify REK against any fines, settlements, or carrier penalties caused by messages you sent without consent.

4. Review-gating prohibition

REKommend will never hide, gate, or filter the public Google review link based on a customer's rating or sentiment. This protects you from Google's review-suppression penalties and the FTC's rule against review hijacking. You agree not to attempt to work around this design.

5. Acceptable use

You will not use REKommend to:

  • Send messages unrelated to reviews for your own business.
  • Send to anyone who has not opted in or who has opted out.
  • Impersonate another business, mislead recipients about who is sending, or use deceptive subject lines.
  • Send content that is unlawful, harassing, sexual, hateful, or promotes illegal goods (the “SHAFT” categories: sex, hate, alcohol, firearms, tobacco are prohibited unless you have specific carrier approval).
  • Reverse engineer, resell, or sublicense the service without written permission.

6. Fees

Subscription fees, billing cycle, and any included message allowances are stated at sign-up. Fees are non-refundable except where required by law. We may change pricing with 30 days notice for renewals.

7. Data

Your data and your customers' data belong to you. We act as your service provider. See our Privacy Policy for what we collect and how we handle it. You may export your data at any time from the dashboard or by emailing support.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. The service is provided “as is.” To the extent permitted by law, REK disclaims all warranties.

9. Limitation of liability

REK's aggregate liability for any claim arising out of these Terms is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

You may cancel at any time from the dashboard. We may suspend or terminate your account for breach of these Terms, especially the consent requirements in Section 3. On termination your data is retained for 90 days then deleted unless you ask us to delete it sooner.

11. Changes

We may update these Terms; the “Last updated” date at the top reflects the latest version. We will email active clients for material changes. Continued use after the change date means acceptance.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in San Diego County, California.
